2/ Content and use of information

The “GLOBE LIVE SHOPPING” brands are registered brands.

All content, pages, scripts, graphics, photographers, and icons on the site and/or on the GLOBE LIVE SHOPPING pages are the exclusive property of Hawker to use them. All rights of reproduction or representation of these are strictly reserved.

Consequently, any partial or complete reproduction, representation, use, adaptation, modification, incorporation, translation, commercialisation, of the website and/or GLOBE LIVE SHOPPING pages, the social media, or their elements, by any process and on any medium whatsoever (paper, digital etc.) shall be prohibited without the prior written authorisation of Hawker, under penalty of constituting an offence of copyright and/or designs and models and/or of brands.

The logos, brands, iconography relating to all other companies and products mentioned on the site and/or on the GLOBE LIVE SHOPPING pages of the social media are the respective properties of their authors and/or owners.

3/ Personal Data

When browsing on the site, users shall be required to give their data.

The website shall be conformed to the French and European standards relating to protecting the privacy and personal data, particularly Law No. 78-17 of 6 January 1978 relating to information technology, files, and freedom, as amended by Law 2004-801 of 6 August 2004, and European Regulation 2016/679 on the protection of individuals concerning the processing of personal data and the flow of such data.

3.1- Data controller

The data controller in charge of personal processing data shall be Hawker.

3.2- Nature of data collected

Data collected on the website shall be that which allows Hawker to identify users directly or indirectly.

This may include nominative data such as surname, given name(s), postal address, e-mail address, telephone number, date of birth and gender.

3.3-  Purposes of collection

Personal data collected on the website shall be used for the following purposes:

Putting Hawker in contact with the user;                                                                                    

Management of the site, operations relating to users, requests relating to user’s rights (right to access, rectification, deletion, opposition, limitation and portability), conflict and litigation related to the use of the site; Improvement of the site

Furthermore, Hawker may equally use the data to satisfy legal and/or regulatory obligations.

3.4-  Time of collection

The user shall freely communicate data collected by Hawker.

Personal data shall be collected during the use of the site when the user sends a contact request to Hawker via the contact form.

3.5-  Consent

The Legal notices shall systematically be brought to the attention of users when they request to be contacted.  The online application request and application shall imply the express’s express, complete acceptance to the legal notices.

By ticking the box: “I have read and accepted the legal notice” when applying, the user consents to his//her personal data being stored and processed by HAWKER and/or its partners.

Users who provide the personal data of a third party must confirm that they have the consent of this third party for use, publication and/or distribution of personal data of this third party on the website.

If the user wishes to withdraw his consent to the processing of his data, he may do so by sending a request to the following address: contact@globe-groupe.com.

The personal data collected on the site are primarily intended for Hawker and are not disclosed to third parties for commercial purposes.

3.6-  Recipients of personal data

Other recipients may have access to personal data.  These include companies that Hawker directly or indirectly controls within the meaning of Article L. 233-3 of the French Commercial Code, its service providers or subcontractors, its customers etc….. The list of recipients may be consulted at any time on request by users.

In addition, Hawker may be obliged to transmit the data collected to a third party in the event of receiving a request from a judicial authority or any administrative authority authorised by law requesting the communication of this information under the legislative provisions in force.  If this is required by law, the user’s consent shall be obtained, or a possibility of refusal shall be provided before any data is transmitted.

Finally, in the event of a change of Hawker’s control, an acquisition, a collective procedure or a sale of Hawker’s assets, the data collected by Hawker may be transferred to third parties.

3.7-  Conservation period

Personal data shall be kept for the duration for two (2) years from the date of the application.

Notwithstanding the preceding data that Hawker needs to retain as evidence, legal or administrative purposes or under the legislation in force may be retained for a more extended period.

3.8-  Users’ rights

Under Law No. 78-17 of 6 January 1978 relating to information technology, files and freedom, as amended by the Law 2004-801 of 6 August 2004, and European Regulation 2016/679 on the protection of individuals concerning the processing of personal data and on the free spread of such data, users have:

a right to rectify their data
a right to delete their data
a right to object to the use of their data
a right to limit their data
a right to portability of their data
a right to complain with the CNI

While exercising one of these rights, users must send Hawker the elements necessary for their identification: surname, given name(s), e-mail, and eventually their postal address. Furthermore, under regulations in force, the request must be signed, accompanied by a photocopy of an identity document bearing the signature, specifying in detail the right they wish to exercise as well as the address to which they wish to receive a reply in the event of the exercise of one of the rights listed above.

Hawker shall then respond within a maximum of one (1) month following receipt of the user’s complete request.

Due to the complexity of the request and/ or the number of requests, the period may be extended to two (2) months on the condition that Hawker informs the user within one (1) month of receipt of the request of the reasons for the postponement.

If Hawker does not comply with the user’s request, Hawker shall inform the user within one (1) month of receiving the request of the reasons for its inaction.

5/ Hypertext Links

The user may have access to various links directing him/her to third party sites on the site.

Hawker shall not be responsible for the content of the sites referenced on the site and/or on the GLOBE GROUPE pages of social media for the information or content provided by third parties or the confidentiality policies of these third parties to which the user of the site has access.

Hawker shall have no control over hyperlinks and/or other promotional formats.

Consequently, Hawker does not give any guarantee concerning in particular:

The truthfulness, quality, completeness, and exhaustiveness of the content of the indexed websites;
the difficulties for the accessing and the functioning of the indexed websites

And it may not under any circumstances be held liable in the event of a dispute arising between a website indexed on the site and/or on the GLOBE GROUPE pages of social networks and one of the users and/or purchasers, in particular, because of losses or damage suffered, the operators of the indexed websites being solely responsible for the content of their site.

6/ Cookies

During the consultation of the site, cookies or other means of recording navigation data collected shall be used by the site or by third parties, service providers and deposited on the user’s terminal (computer, mobile or tablet).

The cookies used by Hawker shall make it possible to identify users, recognise their browser when they connect to the site, record their preferences, and adapt the presentation of the site to the display preferences of the user’s terminal.

The registration of a cookie is subject to the will of the users. Users, therefore, have the possibility of configuring their browsing software in such a way as to oppose, totally or partially (in particular depending on the issuer), the recording of “cookies”. The configuration also offers the possibility of accepting or refusing cookies on an ad hoc basis before recording in the users’ terminal.

Therefore, users who wish to prevent the storage of cookies may follow the procedure specific to each browser ‘s help menu.

These procedures are as follows:

The user must go to the “tools” menu and then to the “options” tab.  Then click on the “privacy” /” show cookies” icon and select the appropriate options.

For Microsoft Internet Explorer 6.0 and above

The user must choose the “tools” menu, then “Internet Options”, click on the “privacy “ tab, then select the desired level.

For Microsoft Internet Explorer 5

The user must choose the “tools” menu, then “Internet Options”, click on the “security “tab, select “internet”, and then “customise the level”.   Finally, in the “cookies” section, choose the appropriate options.

For Google Chrome

The user must choose the “tools” menu, select the “options” section, click on the advanced “options” tab and access the “confidentiality” section. Finally, in the “Show Cookies” section, the user must choose the appropriate options.

For Safari

The user shall go to the Safari menu and choose the “preferences” menu, then click on “security” and select the appropriate options.

7/ Interruption of the site

Hawker shall reserve the right to interrupt the operation of and/or access to the site at any time, with or without notice, in particular, to ensure corrective and evolutionary maintenance or to change the content or presentation.  In so far as possible, Hawker shall inform users before any corrective or evolutionary maintenance operation. Furthermore, the users acknowledge that the site can be interrupted for reasons beyond Hawker’s control and that Hawker cannot, therefore, guarantee continuous access to the site.

In any case, Hawker shall not be held responsible for any interruption and/or malfunction of the site, whatever the cause.

8/ Guarantees – Responsibilities

The users understand and accept that the site should be made available to them” as is” and shall not provide any guarantee, express or tacit, concerning all or part of the site.

Hawker shall endeavour to ensure that the information accessible via the site is accurate and up to date.  However, it does not grant any guarantee in this respect.

Under no circumstances may Hawker be held responsible for any direct or indirect damage, whatever the cause, origin, nature or consequence, resulting from the consultation or use of the site.

9/ Modifications for legal notices

Hawker reserves the right to modify, at any time, the current legal notice to tackle into account any legal, jurisprudential, editorial, functional and/or technical evolution. The version that prevails is the one that is accessible online on the day of the application or job application.  After the publication of the modified legal notice, any consultation of the site shall constitute unreserved acceptance by the latter of the new legal notice.

The French Law shall govern the website.
